FERPA & student records

How SetFlow handles education records, directory information, and parental rights under FERPA.

Our posture

School official with a legitimate educational interest.

When a school adopts SetFlow, we operate as a school official with legitimate educational interest under FERPA — limited to providing the educational service the school has contracted us to provide. We do not sell student data, we do not use student data to train external AI models, and we do not share education records with third parties except as you direct.

Education records

Education records — assignments, submissions, grades, comments — are owned by the school and accessible to the educators and students for whom they're relevant. School admins can see the existence and metadata of records (counts, course assignments) but not the content of student work or chats.

Directory information

Schools control directory information policies for their account. By default, SetFlow does not surface student names, emails, or grades publicly. You can further restrict the visibility of student names within courses (e.g., show first name + last initial only) from the admin console.

Parental rights

FERPA gives parents the right to inspect, request amendment of, and consent to most disclosures of their child's education records. For students under 18, requests should go through your school; we will assist in fulfilling any verified request the school routes to us.

Retention & deletion

Schools set the retention window for student records — typically aligned with district policy (e.g., 1, 3, or 7 years after graduation). At the end of the retention window, records are deleted. See Data deletion.

Data processing agreements

Note

We're happy to sign your school or district's data processing agreement, including state-specific addenda (e.g., the SDPC NDPA, Texas Education Code 32.151, California AB 1584). Email [email protected] with your DPA and we'll respond within five business days.
